By downloading, installing, or using the Burnly mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Burnly AI ("Burnly", "we", "us", or "our").
Burnly is a calorie and nutrition tracking application that allows you to:
To use Burnly, you must create an account using Sign in with Apple. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to provide accurate, current, and complete profile information (such as weight, height, age, and activity level) to ensure accurate calorie and nutrition calculations.
Burnly offers a free tier that includes 1 photo meal scan per day, basic calorie and macro tracking, barcode scanning, manual food entry, water tracking, and workout logging.
The Premium subscription unlocks unlimited photo meal scans, advanced analytics, personalized workout suggestions, intermittent fasting tools, priority support, and early access to new features. Premium subscriptions are billed through the Apple App Store on a monthly or annual basis.

Burnly is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. The nutritional information, calorie estimates, workout suggestions, and health data provided by the App are for informational and educational purposes only.
The App, including its design, features, content, logos, and code, is the intellectual property of Burnly AI and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You retain ownership of all content you submit to the App, including meal photos, food entries, and profile information. By using the App, you grant us a limited license to process your content solely for the purpose of providing the App's services (e.g., analyzing meal photos for nutritional estimation). We do not claim ownership of your content and will not use your meal photos for any purpose other than providing the scanning service.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the practices described in the Privacy Policy.
To the maximum extent permitted by applicable law, Burnly AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health outcomes, arising from your use of the App. Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or completely secure, or that nutritional estimates will be perfectly accurate.
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time by contacting us.
We may modify these Terms at any time. We will notify you of material changes by posting updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the App.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Burnly AI operates, without regard to its conflict of law provisions.
